TURAXUS TRAVEL
TERMS OF USE AGREEMENT
1. DEFINITIONS
In this User Agreement, the following terms shall have the meanings ascribed to them below:

Site: Refers to the website https://www.antalya-boat.com

User: Refers to any natural person who benefits from the services offered on the Site by visiting and/or becoming a member.

Business Partners: Refers to legal entities or natural persons who have entered into an agreement with TURAXUS TRAVEL to offer their products and services to Users via the Site under the conditions announced thereon.
2. SUBJECT OF THE AGREEMENT
This agreement outlines the terms and conditions for the purchase and use of services offered through the Site.
3. GENERAL PROVISIONS
3.1 Through the Site, TURAXUS TRAVEL provides a range of travel services, including but not limited to daily tours, international tours, domestic tours, cruises, hotel bookings, visa services, and travel insurance. The content of these services is at the sole discretion of TURAXUS TRAVEL.
3.2 The availability of travel services may vary periodically based on seasonality and quotas.
3.3 These Terms of Use are an integral component of the tour programs offered on the Site and the package tour contract to be executed upon purchase. They shall not be considered in isolation.
3.4 By using the Site, all individuals are deemed to have accepted these Terms of Use.
4. TRAVEL SERVICES
4.1 Travel services can be purchased instantly online via credit card. If a User has active Gift Points in their account at the time of payment, they may be applied as a discount.
4.2 All purchased travel services require a reservation to be utilized.
4.3 The tours offered on the Site are organized with a minimum participation of 40 people. If the minimum is not met, the final cancellation notice will be issued by TURAXUS TRAVEL no later than 20 days prior to the tour departure date.
4.4 TURAXUS TRAVEL acts as an intermediary between airlines and passengers and is subject to the Hague Protocol of September 28, 1955. The User acknowledges and accepts that flight times and schedules for both chartered and scheduled flights may be subject to change or delay. TURAXUS TRAVEL is obligated to provide prompt notification of any such changes. Children aged 0-2 are exempt from airport tax and service fees.
4.5 Triple rooms are provided subject to hotel availability. These rooms typically feature an extra bed, which may be smaller than a standard bed. Child discounts are applicable only for children sharing a room with two adults. The continental breakfast provided at hotels typically consists of butter, jam or honey, bread, tea or coffee, and fruit juice. Group breakfasts may be served in a separate lounge.
4.6 Panoramic city tours are designed for a general introduction to a city and have a maximum duration of 2-3 hours. The content of these tours may be rescheduled to different days without change. They may also be subject to cancellation due to weather or force majeure. Optional excursions mentioned in the tour program are organized by the local agency with a minimum participation of 20 people. If this quorum is not met, the excursions may be cancelled or the price and content may vary based on the number of participants.
4.7 Participants who opt not to join optional excursions during the tour itinerary agree to wait at a designated rest stop.
5. PURCHASING SERVICES
5.1 Services on the Site can be purchased via credit card, EFT, or money transfer.
5.2 Installment payments may be subject to interest rates based on the terms of the collaborating banks.
5.3 TURAXUS TRAVEL partners with various banks and the payment system provider Paytr (www.paytr.com) to process credit card payments. Transactions will appear on credit card statements as "Paytr Payment Services."
6. GIFT POINTS AND USAGE
6.1 Gift points are calculated based on the service fee for purchased services. Upon completion of a purchase, these points are credited to the User's account on the Site for use in future transactions.
6.2 Users with active Gift Points can request that this amount be applied as a discount to their purchase, provided they are logged into their account on the Site.
6.3 Gift Points are non-transferable and cannot be redeemed for cash.
6.4 Gift Points can only be used as a discount for purchases made on the Site.
6.5 TURAXUS TRAVEL reserves the right to cancel any Gift Points awarded in cases of fraudulent use.
7. CANCELLATION AND REFUND CONDITIONS
The cancellation and refund conditions for tours and excursions purchased through the Site are governed by the relevant articles of the package tour contract, which is provided at the time of booking. The general terms are as follows:
7.1 No right of cancellation exists for promotional or campaign products after a reservation is made.
7.2 For international tours, unless otherwise specified, cancellations requested up to 30 days before the tour start date will be fully refunded, excluding mandatory taxes, duties, and similar legal obligations. For cancellations or changes requested less than 30 days before the tour, the User agrees to pay the entire tour fee as a cancellation penalty.
7.3 For cruises, unless otherwise specified, cancellations requested up to 90 days before the trip will be refunded minus a penalty of 150 euros per person, in addition to mandatory taxes and fees. For cancellations or changes requested less than 90 days before the trip, the User agrees to pay the entire tour fee as a cancellation penalty.
7.4 Name changes are subject to a service fee of 100 Euros and can be made up to 7 days before the tour departure. Name change requests submitted within 7 days of departure are subject to airline approval and additional penalties.
7.5 For international tours and cruises, visa fees, insurance premiums, and any domestic connecting flight ticket fees are non-refundable.
7.6 Force majeure events, as defined by law, for the User or their first-degree relatives (including serious accidents, illnesses requiring treatment, or death), must be proven with a valid document from official state institutions. In such cases, if a written termination notice is provided less than 30 days (or 60 days for cruises) before the tour, the amount paid by the User will be refunded within 14 days of the notice, minus any non-refundable costs paid to third parties.
7.7 TURAXUS TRAVEL reserves the right to partially or completely cancel tours. For international tours, notification will be provided at least 7 days in advance; for domestic tours, at least 2 days in advance.
7.8 Refunds to a credit card may take up to 5 business days to be reflected, depending on the banking institution's processing times.
8. VISA AND PASSPORT
8.1 Visa requirements apply to Turkish citizens for many destinations. Applicants must submit a passport valid for at least 6 months beyond the return date and the required documents specified in the "Visa Required Documents" list, which can be obtained from TURAXUS TRAVEL. For green passport holders, a valid passport is sufficient. Please note that a visa does not guarantee entry, as border control officers retain the final authority to deny entry. TURAXUS TRAVEL is not liable in such instances.
8.2 Turkish citizens traveling with a green passport issued more than 10 years ago must renew it. Failure to do so may result in denied boarding or entry. This responsibility rests with the passenger.
8.3 It is the passenger's responsibility to ensure their passport is not torn, worn, wet, or otherwise damaged. Damaged passports may lead to problems at the border, and any required visa must be in the new passport.
8.4 Visa applications can be submitted up to 3 months before the tour departure. It is highly recommended to complete this process as early as possible to avoid any delays.
8.5 Minors traveling alone or with only one parent may be required by border authorities to provide a document proving parental consent. Parents and minors are advised to be prepared with such documentation.
8.6 Visa issuance is at the sole discretion of the relevant consulate. While TURAXUS TRAVEL will deliver the required documents, it is not responsible for visa denials. Visa and travel insurance fees are non-refundable in the event of a denial. The tour fee will be refunded according to the terms of Article 7.
9. FORCE MAJEURE
Force majeure refers to extraordinary and unforeseeable events that, despite all due care and precautions, prevent the start, continuation, or completion of a package tour. TURAXUS TRAVEL is not liable for damages resulting from a failure to perform or fulfill the contract due to force majeure, including but not limited to:
9.1 Natural disasters, epidemics, or similar extraordinary events such as earthquakes, fires, floods, hurricanes, volcanic eruptions, or lightning.
9.2 International travel disruptions in neighboring countries or in the destination country, including war, mobilization, public uprisings, terrorist acts, riots, civil war, or government-imposed sanctions, embargoes, strikes, or port closures.
9.3 In the event of force majeure, TURAXUS TRAVEL shall not be held liable for damages resulting from the non-execution of the contract.
10. USER RESPONSIBILITIES
10.1 By visiting, using, or becoming a member of the Site, the User explicitly acknowledges and agrees to have read, understood, and be bound by these Terms of Use, and to comply with all applicable laws and regulations.
10.2 TURAXUS TRAVEL reserves the right to amend these terms at any time. Such amendments become effective upon their publication on the Site. Continued use of the Site after amendments are posted constitutes acceptance of the changes.
10.3 All content on the Site, including written and visual materials, is protected by the intellectual property rights of TURAXUS TRAVEL, its vendors, and/or third parties. No content from the Site may be copied, reproduced, or used on other platforms without prior written permission from TURAXUS TRAVEL.
10.4 The User agrees not to engage in any actions that could negatively affect the Site's operation, including reverse engineering, hacking, or using robots, spiders, or similar tools for unauthorized content copying or illegal purposes. TURAXUS TRAVEL reserves the right to exercise its full legal rights and seek damages from Users who violate these terms.
10.5 The User consents to TURAXUS TRAVEL using information provided during registration and purchases for statistical analysis, Site improvement, and enhancing the User experience.
10.6 The User is solely responsible for the security and confidentiality of their account access credentials (username, password, etc.). TURAXUS TRAVEL is not liable for any direct or indirect damages resulting from the User's negligence in protecting this information.
10.7 Unless otherwise requested, the User agrees to receive informative emails about services and campaigns at the email address provided during registration. The User may unsubscribe from this list at any time.
10.8 The Site's Privacy Policy is accessible via the link at the bottom of the https://www.antalya-boat.com page. By visiting or becoming a member of the Site, the User is deemed to have read and accepted the Privacy Policy.
10.9 The User acknowledges that TURAXUS TRAVEL may terminate their membership, restrict their use of the Site, cancel purchased services, or take legal action if the User violates the obligations set forth in this agreement.
11. NOTIFICATIONS
All notifications to TURAXUS TRAVEL or its business partners must be made in writing.
12. AUTHORIZED JURISDICTION
The courts and enforcement offices of Antalya are authorized to resolve any disputes arising from this agreement.
This Agreement has been read, accepted, and entered into force by the User.
