Tour Sales and Distance Service Contract

This contract governs every boat tour booked through antalya-boat.com. It describes how a booking is formed, what each party undertakes, how changes and cancellations are handled and where disputes are resolved. By confirming a reservation online, the guest accepts the provisions below.

1. Parties and Definitions

Organiser: Antalya Boat, a brand operated by Turixa Turizm Ltd. Şti., TÜRSAB-licensed travel agency (licence no. 14082), Arapsuyu Mahallesi 607 Sokak, M. Tabur Apt. No: 24/C/1, Konyaaltı / Antalya, Türkiye. E-mail: info@antalya-boat.com · Phone and WhatsApp: +90 538 708 80 50 · KEP: turixaturizm@hs01.kep.tr.

Guest: the person who places the booking on the website and, through that booking, every participant registered under their name.

Tour: the boat trip, transfer and related services described on the relevant tour page at the time of booking.

2. Legal Framework

This is a distance contract concluded electronically. It is subject to Consumer Protection Law No. 6502 and the Regulation on Distance Contracts. Package tour services are insured within the scope of Article 12 of Law No. 1618 on Travel Agencies.

3. Formation of the Booking

  • Before confirming, the guest reviews the essential features of the tour, the total price including taxes, the payment method and the pre-contractual information shown on the website.
  • The booking becomes binding once the guest confirms it electronically and the Organiser acknowledges it.
  • If, after the service has been performed, the bank or card issuer does not transfer the tour price because the guest's card was used without authorisation for reasons not attributable to the Organiser, the guest remains liable for the amount due.

4. Performance of the Tour

The Organiser delivers the tour with the care expected of a professional travel agency and is responsible to the guest if the service is defective. When it is reasonably necessary, the Organiser may change the boat, vehicle, pickup point or the order of stops. A guest who has a justified reason not to accept such a change may cancel and receive a refund for the parts of the service not used.

5. Cancellation or Postponement by the Organiser

Up to 24 hours before departure, the Organiser may cancel or postpone a tour if the minimum number of participants is not reached or if events beyond its control arise, such as adverse weather or sea conditions, road closures, strikes, terrorism, risk of war, unforeseeable technical failures or other force majeure. No compensation is payable in these cases. Notices may be sent directly to the guest or published on the website.

6. Cancellation by the Guest

Cancellation requests must be made in writing. The fee depends on how long before the tour the request reaches the Organiser:

Product type Time before the tour Cancellation fee
Standard tours 15 days or more None – full refund
14 to 7 days 35% of the tour price
Less than 7 days 50% of the tour price
Less than 24 hours 100% – no refund
Discounted / promotional tours Up to 7 days 35% of the tour price
Less than 7 days 100% – no refund
Special products and services 60 days or more None – full refund
59 to 31 days 25%
30 to 15 days 50%
14 to 7 days 75%
Less than 7 days 100% – no refund

A request to change the tour date is treated as a cancellation. The fees above do not apply if the guest or a first-degree relative dies, or falls ill in a way that prevents travel for at least ten days and this is documented by an official medical board report from a full-fledged state hospital.

7. Transfer of the Booking

The guest may transfer the booking to another person up to seven days before the tour by notifying the Organiser in writing. The original guest and the new participant are jointly liable for any outstanding balance and for costs arising from the transfer.

8. Non-Attendance

If the guest does not appear at the start of the tour and has not informed the Organiser in writing that they will join later, the Organiser may cancel all services booked for the guest after 24 hours. No refund is made in this case.

9. Conduct on Board

Participants follow the instructions of the captain, crew, guide and vehicle staff and do not endanger the safety, peace or property of others. A participant who seriously breaches this rule may be excluded from the tour without a refund.

10. Liability and Insurance

  • Personal belongings remain the responsibility of their owners.
  • Where loss of or damage to luggage results from gross negligence or wilful misconduct of the service provider and an official report is drawn up, compensation is limited to half of the transport portion of the tour price; for items declared and handed over in writing, the limit is the transport cost of the tour.
  • Passport and visa formalities are not part of the service.
  • If the tour is not provided, or not provided properly, the guest is covered by insurance up to the tour price under Article 12 of Law No. 1618. Personal travel insurance covering accidents, illness or repatriation can be purchased separately.
  • Where the Organiser fails to perform outside force majeure, compensation or an alternative service is determined in line with the TÜRSAB Antalya schedule. Accepting and using a substitute service ends the right to claim a refund or compensation for the original service.

11. Complaints

A guest who considers the service defective must inform the Organiser's representative immediately and in writing, so that the issue can be addressed on the spot. A service about which no such notice is given is deemed to have been accepted.

12. Responsibility for Fellow Participants

The guest who confirms the booking acts on behalf of all participants registered under their name and is responsible for their obligations towards the Organiser.

13. Disputes

Disputes arising from this contract are heard by the Consumer Arbitration Committees and Consumer Courts of Antalya. The guest declares that they have read and accepted this contract by confirming the booking electronically.
